Refund & Cancellation Policy

This Refund and Cancellation Policy explains the terms under which you may cancel services with ATIL ("Artallur Technologies," "we," "us," or "our") and request a refund. As a service-based business, our refund terms differ from product-based businesses.
1. Service-Based Refund Terms
ATIL provides digital marketing services that involve ongoing work including strategy development, campaign setup, optimisation, and reporting. Because our team dedicates time and resources from the start of an engagement, refunds are assessed based on the work completed at the time of your request.
2. Cancellation Notice Period
- A minimum of 30 days' written notice is required to cancel any active service engagement.
- Notice must be sent via email to contact@atil.ltd or through other communication channels agreed upon in your service agreement.
- The cancellation effective date will be 30 days from the date we acknowledge receipt of your cancellation notice.
- During the notice period, services will continue as normal and will be billed accordingly.
3. Pro-Rata Refund Calculations
If you have pre-paid for services that extend beyond the cancellation effective date, you are eligible for a pro-rata refund calculated as follows:
- Monthly retainers: refund is calculated based on the number of unused days remaining in the paid period after the cancellation effective date.
- Project-based fees: refund is calculated based on the percentage of agreed deliverables not yet completed, as determined by mutual assessment.
- Quarterly or annual plans: refund for unused full months remaining after the cancellation effective date, minus any early termination adjustment specified in your agreement.
Formula: Refund Amount = Total Pre-Paid Amount - (Daily Rate x Days of Service Delivered) - Non-Refundable Items.
4. Non-Refundable Items
The following charges are non-refundable under all circumstances:
- Setup and onboarding fees: one-time costs incurred for account setup, platform integration, initial audits, and onboarding activities.
- Completed work: fees for services, deliverables, or milestones that have been fully delivered and accepted.
- Ad spend: advertising spend paid directly to platforms (Google, Meta, Amazon) is managed by those platforms and is outside our refund policy.
- Third-party costs: fees paid to third-party tools, software subscriptions, or vendors on your behalf.
- Custom creative work: design, copywriting, or creative assets that have been produced and delivered.
5. Refund Request Process
To request a refund, follow these steps:
- Submit a written request: email contact@atil.ltd with the subject line "Refund Request" along with your company name, service agreement details, and reason for the refund.
- Acknowledgement: we will acknowledge your request within 3 business days.
- Review: our team will review the engagement, assess work completed, and calculate any eligible refund amount within 10 business days.
- Communication: we will provide a detailed breakdown of the refund calculation, including completed work, non-refundable items, and the proposed refund amount.
- Processing: upon mutual agreement, refunds will be processed within 15 business days to the original payment method or via bank transfer.
6. Exceptions and Special Circumstances
- Service failure: if we materially fail to deliver agreed services (as documented in your SOW), you may be eligible for a full or partial refund beyond the standard pro-rata calculation.
- Mutual termination: if both parties agree to end the engagement early, refund terms will be determined through mutual discussion.
- Force majeure: in cases of events beyond either party's control (natural disasters, pandemics, government actions), refund and cancellation terms will be handled on a case-by-case basis.
7. Disputes
If you disagree with a refund calculation, you may raise a dispute within 15 days of receiving the refund breakdown. We will arrange a call to discuss and resolve the matter. If a resolution cannot be reached, the dispute resolution process outlined in our Terms of Service will apply.
